Section 5(A)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or were likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of getting struck by and/or run over by vehicles. a) On or about 4/3/01 on the tipping floor at Wheelabrator South Broward, drivers and helpers were allowed to exit garbage collection truck(s) and walk about in an area where there was high vehicular traffic. Among others, feasible method of abatement to eliminate and materially reduce this hazard are to: 1) Ensuring that employees follow the policies at waste transfer stations, including, but not limited to, having only one person in each garbage truck being allowed onto the tipping floors, while wearing appropriate personal protective equipment.
