Section 5(A)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or were likely to cause death or serious physical harm to employees in that employees were exposed to possible capsizing of the boats in which they were working: (a) On or about 03/09/01 employees working in boats on water were exposed to the hazard of drowning due to the employer not installing baffles in a tank used to store herbicide or using a smaller tank to prevent the fluid inside from shifting and the increased weight applied to that side causing the boat to become unstable. Among other methods, two feasible and acceptable abatement methods are to use a tank with internal baffles installed to prevent the fluid from shifting or to use a smaller tanks so that the volume of fluid does not posses the weight to cause a hazard. PLEASE NOTE: CERTIFICATION OF ABATEMENT IS REQUIRED FOR THIS VIOLATION.
