Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: At the facility, industrial powered trucks were not equipped with seatbelts in the following instances: a.The Nissan forklift, Number 00188 (Model CPF02) was not equipped with a seatbelt as required. b.The Clark forklift, Number 00186 (Model GCS25MB) was not equipped with a seatbelt as required. c.The Komatsu forklift, Number 92038T was not equipped with a seatbelt as required. d.The Komatsu forklift, Number 94007 was not equipped with a seatbelt as required. This condition exposed employees to the hazard of being struck by the forklift in the event of a tip-over accident. A feasible and acceptable abatement method to correct this hazard is the installation of seatbelts for the indicated forklifts.
