Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: The hazard of being struck by and caught in-between heavy loads: On or about July 25, 2000: a) The lug mounted 2 ton hook and chain used to transport heavy materials into the press room from the court yard, did not have a limit switch and was not tested prior to use; b) Employees were not provided with a tag line to use, to prevent loads from shifting; and c) The employer did not conduct monthly safety inspections on the chain of the Budgit 2 ton hoist. Among other methods, one feasible and acceptable method to correct this hazard is to develop and adopt the rules and procedures which are consistent with an inspection and maintenance program complying with ANSI B30.16, The American National Standard for Underhung Hoists, which requires unsafe conditions disclosed by hoist inspections, to be corrected by adjustments, repair, or replacement before continuing the use of the hoist.
