North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being struck by moving object: a)establishment, in that the employer had not ensured that operators of automotive lifts had been instructed in the safe use and operation of the lifts as referenced in the manufacturer's manual (page 12) and ANSI B153.1-1981 (page 8), and b)establishment, in that the employer had not ensured that employees who conducted automotive safety/emissions test followed the requirements of the instructions as outlined in the program software as shown on the monitor.
