Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards associated with flying debris while operating the road header machine without an adequate screen in front of the operator cab: One feasible means of abatement is to design and install a higher screen with smaller spacings to block out the flying debris and still maintain adequate visibility for the operator. East bound tunnel at face of mezzanine deck: Employees operating the Webster roadheaders at the face of the tunnel wall were not adequately protected from flying debris such as wood splints and rock chips.
