Section 5(a)(1) of the occupational safety and health act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to slipping and falling hazards while working at an ice covered construction site not adequately sanded. Among other methods, one feasible and acceptable method to correct this hazard would be spreading sand throughout the areas of the construction site that employees required access. Location: Berkley Middle School, Berkley, MA a)The employees and those of sub contractors were exposed to slipping and falling on ice in areas where they were required to access their work areas. b)The Berkley Fire Department was exposed to the same hazards when they were called to the site to rescue a seriously injured employee.
