Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a) The hazard of being caught between the 25,842 pound pitman assembly and a 4 feet high structural member while in the process of re-installing the pitman assembly into the Cedarapids portable rock crusher when a link broke in the chain on a portable chain puller rated at 3 tons on or about January 26, 2000 and at times prior thereto at the Equipco, Inc. facility in Missoula, Montana. Among other methods, one feasible and acceptable abatement method to correct this hazard would be to provide a chain puller with an adequately rated capacity to handle the load. Abatement certification and documentation is required for this item.
