Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the dangers of felling trees: a) 150 Ridge Rd. Hartsdale, NY On or about 7/18/00, employees of Dependable Tree Service were exposed to the hazards involved with felling trees due to the following: the employee did not make the proper notch in the tree. They were not familiar with the requirements of the ANSI Z133.1-1994. According to paragraph 9.5.4.1 the depth or penetration of the notch shall be about one-third the diameter of the tree. Among other methods, one feasible and acceptable abatement method to correct this hazard is to develop a program following the recommendations and practices found in ANSI Z133.1-1994. NOTE: the employer need submit certification or documentation of abatement of this violation as required by 29 CFR 1903.19.
