Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: the hazard of being struck by the hopper portion of the Leach 2RII Packmaster, rear end loaded body that was mounted to a Mack truck: Location: truck routes, Westchester County, NY On or about: 1/24/00 a) The employer did not ensure that the tailgate clamps on the Leach 2RII Packmaster, rear end loaded body, were properly maintained and secured. The 2RII Packmaster, rear end loaded body was mounted to a Mack truck, New York commercial license plate number HS1329, company vehicle number G-12. AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORRECT THIS HAZARD IS: 1) Repair/replace the bent portion of the body into which the passenger side tailgate clamp fits. Ensure that the tailgate clamps are tightened securely before starting to load as specified by Operating Function #35, Section 2 Safety Precautions, page 2-5, in the Leach 2RII Packmaster Operators Manual. AND 2) Train employees on the hazards associated with tailgate clamps and ensure that employees are not engaging in the operation known as 'backpacking'. NOTE: Because abatement of this violation is already documented in the inspection case file, the employer need not submit certification or documentation of abatement of this violation as normally required by 29 CFR 1903.19.
