Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to various hazards associated with riding, working on and driving the Labrie 200 Side Loader: a)Work area: The employer did not develop, implement or maintain an inspection policy that would comply with the operators manual and the American National Standards Institute ANSI Z245.1 - 1992 for Mobile Refuse Collection and Compaction Equipment Safety Requirements, on or about 6-7-00. ABATEMENT NOTE - ONE FEASIBLE AND ACCEPTABLE METHOD OF ABATEMENT WOULD BE TO DEVELOP, IMPLEMENT AND MAINTAIN A PRE AND POST TRIP INSPECTION POLICY TO ENSURE THAT SAFEGUARDS WHICH ARE REQUIRED ARE IN PLACE AND OPERATIONAL.
