Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck by the drum cleaner tank lid. a) On May 8, 2000 an employee was struck in the head by the metal lid of the drum cleaner tank. The pneumatic lifters used to support the lid were non- functional and there were no other safety devices present to ensure the lid remains the open, vertical position after being raised. The lid, when raised in the open, vertical position, is unstable and can slam shut with a slight jarring. The steel lid weighed approximately 68 pounds. Abatement Note: Among others, some feasible and acceptable means to abate this hazard are to: 1) Replace the pneumatic lifters with lifters of sufficient strength to prevent the lid from falling closed unexpectedly. 2) Replace the pneumatic lifters with a spring tensioning system to prevent the lid from falling closed unexpectedly. 3) Replace the pneumatic lifters with a counter weight system to prevent the lid from falling closed unexpectedly. 4) Install a latching device to positively lock the lid when opened to prevent the lid from falling closed unexpectedly.
