Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing of likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of a crushing injury due to failure to train employees in the safe and proper methods of removing heavy equipment wheels: a) The employer failed to train, advise and supervise employees with regard to removing heavy equipment tires. On or about August 30, 1999, an employee was fatally injured in an accident while removing a Firestone Super Deep Tread Loader Dozer tire from a 992C wheel loader manufactured by Caterpillar, Inc. Condition exposes employee(s) to a struck-by hazard. Among other's, some feasible and acceptable abatement methods to correct this hazard include, but are not limited to, the following: 1. Ensure that wheel removal procedures follow the manufacturer's instructions. 2. Ensure that inexperienced employees are conducting wheel removal operations under the supervision of experienced workers when on the-job-training is utilized and those experienced workers need to be aware that they are responsible to oversee the inexperienced personnel. 3. Ensure that all personnel that may be engaged in dangerous activities, such as removal of heavy equipment tires, are present for the job briefing.
