Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing and falling hazards: On or about July 29, 1999, an employee using the hand operated elevator located at the work place was exposed to fall hazards and crushing hazards created from the elevator not being inspected and maintained in accordance with the American Society of Mechanical Engineers ASME A17.1 - 1996. The hand elevator was not inspected and/or maintained as follows: a) Elevator inspection intervals exceed six months. b)The elevator entrance was not equipped with a guardrail or barrier to prevent employees from entering the car landing area. Among other methods, one feasible and acceptable abatement method to correct this hazards is: 1) Inspect the hand elevator at intervals not longer than 6 months as required by ASME A17.1, Rule 1010.3; and 2)Provide a self-closing or manually operated horizontally slide or swinging hoistway door capable of being kept closed as required by ASME A17.1, Rules 600.5a and 600.5b. 29 CFR 1903.19(c)(1) requires certification that the abatement of the above violation is complete.
