Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing hazards: a.On or about August 3, 1999, in building 7 on the 7th floor, an employee was positioned at one of four truss lowering mechanical jacks and standing between a horizontal concrete formwork table and a concrete column while the formwork was being lowered. The placement of the jact and the employee's position exposed the employee to the hazard of being crushed between the formwork and the column when a jack used to lower the formwork failed and the formwork suddenly shifted. Among other methods, one feasible and acceptable method to correct this hazard is follow procedures that are mandated by American National Standard A10.9-1983 Sec. 7.6.7--to ensure that a qualified person inspects the formwork prior to any movement to ensure that all components are properly placed and adjusted. The evaluation of the formwork components' placement and adjustments would prevent employees that are assisting in the operation from being positioned between the formwork and fixed objects.
