Text For Citation: 01 Item/Group: 001 Hazard: STRUCK BY
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which are free from recognized hazards that were likely to cause death or serious physical harm to employees in that an employee was exposed to hazards of being struck by or run over: a) Mountain Rd. - An employee was subject to the hazard of being struck by or run over due to faulty equipment of a 1986 Mack tractor and a 1995 Rogers trailer due to the following conditions: (a) The tractors' emergency brake system failed, (b) the wheels of the vehicle combination were not chocked, and (3) the vehicle combination was not parked on level ground. On or about 06/25/99. Among other methods, feasible and acceptable abatement methods to correct the hazards are to: 1) Assure that parts and accessories are in safe operating condition as required in 49 CFR 396.3A1: Parts and accessories shall be in safe operating condition at all times. These include those specified in Part 393 of this subchapter and any other additional parts and accessories which may effect safety of operation, including but not limited to, frame and frame assemblies, suspension systems, axles and attaching parts, wheels and rims, and steering systems. 2) Develop and implement a policy to assure that wheel chocks be used when connecting and/or disconnecting trailers from tractors and while performing service and maintenance. 3) Develop and implement a policy that assures employees follow the trailer manufacturer's instruction to "Locate the trailer on level ground with a grade no greater than 3 percent, then set the brakes on the tractor".
