Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing injuries from over turning fork lift,due to the fact that the operator restraint system (seat belts) provided on fork lift trucks were not required to be used. (a)Worksite, employee was operating a powered industrial truck TCM Model 806 Wheel Loader without wearing the seat belt provided. The vehicle was backing down a roadway and the left rear wheel entered a depression approximately 15-16 inches in the road causing it to overturn. The operator was thrown to the ground and struck by the overhead protective roof; on or about 07/12/00. ABATEMENT NOTES: Among others, one feasible method of abating this hazardous condition is: 1.Insure that all operators of powered industrial trucks on site are wearing protective safety devices such as seat belts as required by ANSI B56.6 1993. 2.Follow the manufactures recommended procedures while operating TCM wheel loader model 806 page 2 section 4.2 "Wear the seat belt to maximize the protection capability of ROPS (ROLLOVER PROTECTIVE STRUCTURE) canopy when the machine is so equipped". Also page 13 SEAT BELT." The seat belt protects the operator from being thrown out of the operators seat in the event of the loader turning over. It is equipped on the ROPS canopy and ROPS cab. The seat belt functions as a unit with ROPS canopy or ROPS cab".
