Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to THE HAZARD OF BEING STRUCK-BY THE LOAD SHOULD THE OVERHEAD HOIST FAIL: a)Maintenance area, on or about 10/18/00: Overhead hoist used for lifting materials. 1. Upper limit switch did not work. 2. Overhead hoist was not being inspected on a frequent and periodic basis. ABATEMENT NOTES: Among other methods, one feasible and acceptable method of abatement is to: Repair upper limit switch, and perform frequent and periodic inspections of the overhead hoist.ad
