Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a serious fall hazard while operating the JLG 33RTS scissor lift.The lift was not provided with a firm, stable foundation surface to prevent the lift from overturning when elevated. Among other methods, one feasible and acceptable abatement method is to position the lift on a firm, stable surface thereby complying with the manufactures requirements found posted on the lift: (a)Jobsite: Employees required to conduct work on the roof area were exposed to a serious fall hazard while operating the JLG 33RTS scissor lift which was sitting on an unstable mound of earth.
