Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that weigh-up operators were exposed to being struck by falling material. Among others, one feasible and acceptable method to correct this hazard is that at conveyor transfer, loading or discharge points where unconfined and uncontrolled free fall of material can result from flooding ricocheting, overloading, trajectory leakage or a combination thereof, such unconfined and uncontrolled free fall of material shall be prevented if it would create a hazard to personnel as required by the American National Standards Institute (ANSI) B20.1 - 1993 Section 5 paragraph 5.13(a). a)From September 1999 through March 2000 these operators were exposed to falling loads of 100 pound bundles of rubber from the loader conveyor discharge on the weigh up machines.
