Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being struck by the counterweight of the excavator. Indian Trail & Farnsworth Jobsite - The swing radius of the excavator was not marked off. Among feasible means of abatement would be to comply with The Equipment Manufacturers Institute Safety Manual, and; 1. Require employees to mark off swing radius every time and excavator is used.
