Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing injures from possible overhead structure/hoist failure: (A)Sawmill: On 30 August 2000, and at times prior thereto, the hook for the Dayton electric chain hoist was not inspected on a frequent and periodic basis in accordance with the American Society of Mechanical Engineers (ASME) Safety Standards for Cableways, Cranes, Derricks, Hoists, Hooks, Jacks, and Slings, ASME B30.10a-1996, paragraphs 10-1.2.1.2 and 10-12.1.3. (B)Sawmill: On 30 August 2000, and at times prior thereto, the Dayton electric chain hoist was not inspected on a frequent and periodic basis in accordance with the American Society of Mechanical Engineers (ASME) Safety Standards for Cableways, Cranes, Derricks, Hoists, Hooks, Jacks, and Slings, ASME B30.16b-1995, paragraphs 16-2.2.1.2 and 16-2.2.1.3. (C)Sawmill: On 30 August 2000, and at times prior thereto, the overhead support structure for the Dayton electric chain hoist was not inspected on a frequent and periodic basis in accordance with the American Society of Mechanical Engineers (ASME) Safety Standards for Overhead and Gantry Cranes (Top Running Bridge, Single Girder, Underhung Hoist), ASME B30.17-1992, paragraphs 17-2.1.2 and 17-2.1.3. (D)Sawmill: On 30 August 2000, and at times prior thereto, the supporting structure and the Dayton electric chain hoist did not have a record documenting that an appropriate rated load test had been performed, in accordance with the America Society of Mechanical Engineers (ASME) Safety Standards for Overhead and Gantry Cranes (Top Running Bridge, Single Girder, Underhung Hoist), ASME B30.17-1992, paragraph 17-2.2.2. (E)Veneer Plant: On 30 August 2000, and at times prior thereto, the hooks for two pneumatic chain hoists were not inspected on a frequent and periodic basis in accordance with the American Society of Mechanical Engineers (ASME) Safety Standards for Cableways, Cranes, Derricks, Hoists, Hooks, Jacks, and Slings, ASME B30.10a-1996, paragraphs 10-1.2.1.2 and 10-12.1.3.
