Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to rollover accidents from operating fork trucks on unlevel surfaces without the use of seat belts: (a)Parking lot - Employee was observing off loading sheets of particle board with a Mitsubishi fork truck from a tractor trailer in an unpaved, snow covered parking lot without using the seat belt which was provided on the fork truck. ABATEMENT:One feasible means of abatement, among others, is to enforce the use of seat belts on all forklifts equipped with them.
