Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to hazard of potential crushing and/or fractures. a.Throughout saw mill and yard area: An employee was operating a Clark model GPX-40 powered industrial while operating over rough and varied terrain. This exposed the employee(s) to potential fractures and/or crushing injuries due to the rollover and/or collision of powered industrial trucks. AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORRECT THIS HAZARD IS TO REQUIRE THE USE OF THE SEAT BELT WHICH IS PROVIDED ON THE POWERED INDUSTRIAL TRUCK.
