Text For Citation: 01 Item/Group: 001 Hazard: LIFTING
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: On and prior to January 7, 2000, employees were exposed to the hazard of being struck by or crushed by the Bartlett lifting device in the event the truck frame failed. On and before January 7, 2000 employees used the Bartlett lifting device, serial number 257, in conjunction with an Army 2 and 1/2 ton cargo truck, serial number 2320-00-055-9264, while dumping trailers filled with scrap and the truck was not designed and constructed to safely handle the forces imposed. Among other methods, the following is a feasible and acceptable method of abating the hazard: Assure that the vehicle used in conjunction with the lifting device meets the requirements stated in the lifting device operator's manual, including the proper gross weight capacity.
