Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: the hazards of crushing injuries from equipment rollover. At the repaving jobsite, between approximately 9500 and 10500 Tallmadge in Diamond, Ohio the 1988 Bomag BW 130 AD tandem vibratory roller was used to roll berms on the side of the asphalt road where there were adjacent inclines of sufficient length and steepness to allow the self-propelled steel drum roller to overturn. The Bomag dual drum roller was operated without a rollover protection structure (ROPS) and seatbelts. Among other methods, one feasible and acceptable method to correct the hazard is to ensure that Rollover Protection Structures (ROPS) and Seat Belt are installed on the dual drum roller and that operators are required to use the seat belt, or limit this type of equipment to terrain where a rollover hazard does not exist and use alternative compaction equipment. ROPS, if installed, shall meet Manufacturer's specifications where required and/or be in accordance with the American National Standard SAE J 1040 - 1994 (or newer) Performance Criteria For Rollover Protection Structures For Construction, Earthmoving, Forestry, and Mining Machines.
