Minn. Stat. 182.653 subd. 2: The employer did not furnish to each employee, conditions of employment and a place of employment free from recognized hazards which caused or were likely to cause death or serious injury to employees; specifically: An untrained temporary worker was fatally injured on February 11, 1999 after crawling into the rear opening of the Gribetz Wrapper and having the platen on this automatically controlled machine actuate. Warning signs or markings to call attention to the potential danger(s) or hazard(s) were not firmly attached to the machine at the outfeed/ exit end of the Gribetz Wrapper and the Spuhl-Anderson Wrapper. The danger of a crushing injury below the platen and below the heat-sealing bars, and the potential burn hazard below the heat-sealing bars, were not marked with appropriate signs as specified in sections 4.6.8 and 4.8.3 of ANSI B155.1, American National Standard for Packaging Machinery and Packaging-Related Converting Machinery " Safety Requirements For Construction, Care, and Use.
