T.C.A. 50-3-105(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees. In that, the employer did not provide a safe work place as the employees were exposed to the following hazardous situations relating to tree felling: 1. Employees were not 2 times tree height away from the tree being felled, which was in violation of the company's own safety procedures and TOSHA logging standard. 2. The tree was not properly hinged as required by the company's safety procedures and the TOSHA logging standard. 3. The tree was not properly notched as required by the company's safety procedures and the TOSHA logging standard. 4. A rope was not used to start the tree falling in the right direction as required by the company's safety procedures. ABATEMENT VERIFICATION REQUIRED
