Text For Citation: 01 Item/Group: 001 Hazard: STRUCK BY
North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a)being struck by vehicular traffic. Employees working in the right southbound lane of Salisbury Ave. at 7th St. on March 11, 1999 were not provided the protection of traffic control devices as prescribed in the Manual on Uniform Traffic Control Devices which resulted in two employees being struck by an automobile causing injuries to both employees and the subsequent death of one of the employees on March 13, 1999. Among other methods, one feasible and acceptable abatement method to correct this hazard is to prohibit employees from working on the shoulder of and in roadways where they are exposed to being struck by vehicular traffic unless they are protected in their work zone by the use of uniform traffic control devices as prescribed in the Manual on Uniform Traffic Control Devices specific to the conditions the employees find themselves. ¿Reference; ANSI D6.1, Manual on Uniform Traffic Control Devices (MUTCD), 1988 Edition, Revision 3 1993, Part VI, Chapters 6g-7, 6G-8, 6H-2(c)(1)!
