Section 5(a)(1) of Public Law 91-596, the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to the hazard of being struck by falling loads: On January 12, and 16, 2001, during the assembly process in Silver Solder, Off Highway, and departments throughout the plant, purchased and shop made below-the- hook lifting devices were used on cranes and hoists and the lifting devices had no nameplate or permanent marking identifying the manufacturer's name and address, serial number, lifter weight, and rated load. (Reference ANSI/ASME B30.20b-1996, Below- The-Hook Lifting Devices, Chapter 20-1, Section 20-1.2), Among other methods, one feasible and acceptable abatement method is to affix a nameplate or other permanent marking to the devices in accordance with the requirements of ANSI/ASME B30.20b-1996.
