Section 5(a)(1) of Public Law 91-596, the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to the hazard of being struck by moving tractor. (a)Repair Shop - December 11, 2000, while standing on the concrete floor in front of the right rear tractor tire, employee turned ignition to start engine of Massey Ferguson 383 tractor, SN E04051; the tractor did not have the parking brake engaged, gear levers were not in the neutral position, and the safety start system was bypassed and not functional. Among other methods, one feasible and acceptable method to correct this hazard is to follow manufacturers recommendations published in the Massey Ferguson 300 Series Tractor Operator Instruction Book, Publication No.1856 706 M1 and ensure that prior to servicing equipment safety start system is operational, and tractors are started following manufacturers guidelines, i.e., start engine from the driving position, ensure parking brake engaged, gear levers in neutral positions.
