Section 5(a)(1) of Public Law 91-596, the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to a struck by hazard from entering the excavator swing area because the company did not install safety barriers to the side and rear to prevent unauthorized employee entry: (a)Highway 51 South - On August 4, 2000, one employee was struck and crushed by an hydraulic excavator while walking between the excavator and the earthen embankment. Among other methods, one feasible and acceptable abatement methods to correct this hazard includes but not limited to: (1)Install safety barriers to the side and rear area of the swing pattern to prevent employees from walking into the working area in accordance with the recommendation of the Equipment Manufacturers Institute Safety Manual for Operators and Mechanics of Hydraulic Excavator, and/or (2)Position a signalman for dangerous area where the view is not clear in accordance with the recommendation of the KOMATSU Operation and Maintenance Manual, Section I-12.
