Section 5(a)(1) of Public Law 91-596, the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to: falling heavy loads due to employer's failure to provide the same size, grade and construction of replacement hoist load line wire rope as had been recommended by the crane manufacturer. (a)Gulf Coast Pre-Stress, Inc.'s East Yard, Lot 5, South of the New Girder Pouring Beds - Employees attaching transport tie-down eye-bolts and chains to 73.3 ton Bulb-T Girders, for the Florida DOT Project #SP52050-3524, were exposed to being crushed by falling load(s) due to the employer having earlier replaced the hoist load line(s) for Mi-Jack Model 750-D Travelift Cranes #7 & #4 with 5/8 inch diameter, 6 x 26, EIPS, IWRC, Right Alternate Lay, wire rope instead of the crane manufacturer's recommended 5/8 inch diameter, 6 x 36, EIPS, IWRC, Right Regular Lay, wire rope. Among other methods, one feasible and acceptable abatement method to correct this hazard is to use only wire rope of the size, grade and construction recommended by Mi-Jacks Products, Inc. of Hazel Crest, IL.
