Section 5(a)(1) of Public Law 91-596, the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to: (a)Hazard of being caught in moving parts of Ditch Witch Tractor Model 8020 Turbo SN 0659 and Attachment Model H710 SN 2N2014 when on or about May 20, 1999, on the Construction Site, Poorhouse Water Assn. waterline right-of-way, County Rd. 100, Carrollton, MS, employees moving water pipe over the roll bar of an operating trencher worked within one foot of moving tractor/trencher parts. Among other methods, one feasible and acceptable method to correct this hazard is to follow the instructions in the tractor Operator's Manual located in a pocket by the operator's seat, (1) Keep everyone at least 6 feet from machine and attachments; (2) Allow 3 feet between end of boom and obstacle. (b)Hazard of being struck by Ditch Witch Tractor Model 8020 Turbo SN 0659 and Attachment Model H710 SN 2N2014 when on or about May 20, 1999, at the construction site, Poorhouse Water Association waterline right-of-way, County Road 100 near Carrollton, MS, the start interlock device was not functioning to indicate the operator was in seat, ground drive control in neutral, and attachment speed/direction control in neutral. Among other methods, one feasible and acceptable method to correct this hazard is to replace the safety switch located underneath the operators seat as detailed in the tractor operator's manual.
