Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: The hazard of being struck by a falling carcass unloader when the kick plate puts the unloader in the E-Stop Mode. This may result in injury from the blow of the falling carcass unloader and/or from being crushed between the carcass unloader and equipment below. Among other methods, one feasible and acceptable method to abate this hazard is to ensure that the counterweight on the carcass unloader has enough weight to prevent the carcass unloader from falling when the E-Stop Mode is engaged. ***Certification and Documentation of Abatement Required***on
