North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a)struck by motor vehicles - the employer did not take measures to assure compliance by failing to administer warning cones as a buffer to vehicular traffic for employees installing sidewalks and erosion control near a busy street on 10/06/98 in accordance with the Manual on Work Zone Safety - Guidelines for Municipalities, Utilities, and Contractors. Among other feasible methods, one feasible and acceptable abatement method to correct this hazard is to train employees with this safety rule, monitor the use of the warning cones, and utilize a disciplinary policy where necessary to assure compliance.y
