Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a struck-by hazard from a falling load: a) Manor Care/Arden Courts site - A CORMACH knuckleboom crane was used to hoist bundles of roofing insulation from the bed of truck trailers to the roof of the structure. Rigging for the load consisted of synthetic web slings and 2" X 4" (nominal) boards. The 2" x 4" boards, used as a structural component of the lifting device, were not designed to withstand the forces imposed by its rated load, with a minimum design factor of 3, based on yield strength of the material. (Refer ANSI B30.20) ABATEMENT NOTE: One feasible and acceptable method to abate this hazard is to use rigging equipment and devices specifically constructed and approved for such purposes. Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.
