Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a)On or about 3 Feb 2000, at Sloss Industries Corporation, located at 3500 35th Avenue North, Birmingham, AL., the deadman switches on the hot cars have been disabled, the pusher car does not have a deadman switch and neither are maintained in good repair and working order. Among other methods, one feasible and acceptable method would have been to keep the deadman switches in working order on the hot cars and to install a deadman switch to the pusher car and make routine repairs and maintenance.
