Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that was causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a)On or about January 11, 2000 - Employees were exposed to the hazard of possibly falling under moving rail cars and crushed between rail cars due to defective equipment such as fixed ladders, grab irons, foot sills, brake platforms, and defective or missing cut levers: 1) Foundry track - Rail car #A2286 - had defective grab iron. 2) Foundry track - Rail car #A2255 had defective brake platform and defective fixed ladder. 3) Foundry track - Rail car #A2322 had defective brake platform. 4) Main yard - Rail car #A2355 had defective foot sill, a defective ladder rung, and a defective brake platform. 5) Main yard - Rail car #A2199 had a defective foot sill and missing cut lever. 6) Main yard - Rail car #A2278 had a defective foot sill. 7) Main yard - Rail car #A2302 had defective foot sill and defective ladder rungs. 8) Main yard - Rail car #A2326 had a defective foot sill. 9) Main yard - Rail car #A2344 had a defective foot sill. 10) Main yard - Rail car #A2306 had a defective grab iron and missing cut lever. 11) Main yard - Rail car #A2355 had a defective brake platform. 12) Main Yard - Rail car #A2344 had a defective cut lever. 13) Main Yard - Rail cars #A2220, A2244, A2285, A2325 had missing cut levers. Among other methods, one feasible and acceptable abatement method would include, but would not be limited to: Adhere to the requirements of 49 CFR 231 and ACIPCO'S PROGRAM FOR SAFETY, February 1982, GENERAL YARDS DEPARTMENT, B-14, #51. Establish a periodic maintenance program and insure that defective appliances are identified and repaired.
