Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being crushed by forklift in the event of a rollover: Employees who operate forklift trucks were not required to wear protective devices (seatbelts) that were equipped on TCM Powered Industrial Trucks. Observed on 8/5/99. a)Warehouse Area:Employees not required to wear seatbelts while operating forklifts.
