Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being crushed by forklift truck in the event of a rollover:a)Throughout the Warehouse Area, Employees who operate forklift trucks were not required to wear protective restraint devices (seatbelts) that were equipped on Power Industrial Trucks. A)Warehouse Area:Employees not required to wear seatbelts while operating power industrial trucks. Violation observed on or about 6/10/99.
