Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being struck by a steel pipe while working in proximity to a demolition operation within an excavation, where sections of 6 inch ductile steel pipe were being removed with force applied by the bucket of an excavator to sections of the pipe, to pry them free of their connection points. One feasible method of abatement among other methods would be to disconnect the ends of the sections of installed pipe and hoist the sections of pipe from the excavation, using an acceptable and approved hoisting method. Jobsite: C17A1, Central Artery, Work Zone # 935, in front of 400 Atlantic Avenue, Boston, MA: On or about February 27, 1999, employees were exposed to serious injury by being struck by a pipe while working in proximity to a demolition operation within an excavation, where a section of 6 inch ductile steel pipe, approximately 18 feet in length, was thrown from its previously installed location, by the bucket and hydraulic arm of a Caterpillar M-138, excavator.
