North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a)drowning or serious injury. The employer did not provide means of identifying and locating sources of differential pressure which could overpower a diver prior to exposing the diver drowning or serious injury on and before April 16, 1998. Among other methods, one feasible and acceptable abatement method to correct this hazard is to use a line with a lightly weighted rag to probe for sources of differential pressure.
