Section 5(A)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that: 7200 SW 88th St., Miami, FL: On or about July 31, 1999, an employee under a joist hoisted in place with a Terrex Handler forklift, that was tack welded on only one side, was not removed prior to removal of the rigging in an area with limited clearance. Among other methods, one feasible and acceptable method to correct this hazard is for the employer to: Ensure that personnel are cleared from underneath loads prior to operating the forklift and unrigging the suspended load as specified in the following documents: 1) The ASME / ANSI Safety Standard for Powered Industrial Trucks, USAS B56.1 - 1969, and 2) The Baraga Products Square Shooter Operator's manual for Terrex Handler Model numbers SS-624, SS-636, SS-836, SS-842, and SS-1048. PLEASE NOTE: CERTIFICATION OF ABATEMENT IS REQUIRED FOR THIS VIOLATION.
