North Carolina General Statute 95-129 (1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: a)job site - employee(s) was transported in and out of a trench 7.5 feet deep and into a confined space while holding on to the inside of a concrete manhole extension ring slung under the bucket of a PC 120 Komatsu Hydraulic Excavator. " Among other methods, one feasible and acceptable abatement method to correct this hazard is to train all employees not to use equipment for transportation which is not designed for the purpose"
