Title 40.1-51.1.(A), Code of Virginia: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: possible mechanical and electrical failure of the Model 45HA, JLG aerial lift used on the job site by an employee, 3444 Western Branch Blvd., Chesapeake, Va., as there was no proof of the machine being inspected or tested for defects by the employer. "One feasible and acceptable abatement method, among others, to correct this hazard is to adhere to Section 8.3(2) American National Standards Institute A92.2-1990, Safety Code for Vehicle-Mounted Elevating and Rotating Aerial Devices: Written, dated and signed reports and records shall be made of periodic inspections and tests and retained for a period of five years or as required by applicable regulations.
