40.1-51.1.(a): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of the damaged hydraulic hose on the W. A. Whitney angle shear located outside the shop. The Whitney angle shear had the main hydraulic hose damaged and cracked 1 inch from the upper hydraulic hose fitting. This hose was not maintained in a safe operational condition as required by the manufacturer of the shear, and presented the possibility of hydraulic hose failure causing catastrophic loss of hydraulic pressure and failure of the angle shear while operating. One feasible and acceptable abatement method, among others, to correct this hazard is to maintain the hydraulic hoses of the Whitney angle shear in good operating condition by authorized repair or replacement of damaged hoses.d
