Code of Virginia, Title 40.1-51.1.(a): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that at the garage facility, 5417 Franklin Road, Roanoke, Virginia, it was not assured that all employees were in the clear before swinging the boom arm of the Case 580D backhoe. This caused an employee to be exposed to fatal injuries resulting from being struck in the back by the backhoe. "One feasible and acceptable abatement method, among others, to correct this hazard is to train employees to adhere to industry recognized practices as outlined in the Hydraulic Excavator Users Safety Manual as published by the Construction Industry Manufactures Association that stated in part..."Be sure everyone is in the clear before swinging or moving in any direction. NEVER swing or position attachments or load over ground crew or truck cab."
