Title 40.1-51.1.(A),Code of Virginia: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that: An employee was exposed to a crushing hazard at the job site, 23105 Calvin Drive, Franklin, Va., as the operating lever controlling the Thieman lift tailgate of the 1986 Ford, F-350 Truck, had been installed pointing upward and was not equipped with a latch of other device which would prevent accidental starting or tripping of the mechanism. "One feasible and acceptable abatement method, among others, to correct this hazard is adhere to the 1926 Construction Safety and Health Standards, section 601(b)(11)...Operating levers controlling hoisting or dumping devices on haulage bodies shall be equipped with a latch or other device which will prevent accidental starting or tripping of the mechanism; or in the alternative, install the operating lever for the lift tailgate in a downward position with original manufacturer's specifications.
