North Carolina General Statue 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees condition of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a fall to lower elevation: a)jobsite - an employee using a JLG Industries model 2033-E serial CO37671 scissors lift was working with one leg draped over the top of the guardrail and did not have firm footing on the platform and was not wearing any fall arrest equipment (ref. ANSI A92.6-1979-14.2.6). One feasible and acceptable abatement method, among others, to correct this hazard is to always park the scissors lift directly under the work to be performed so that the employee can stand within the confines of the platform to perform the work.rm
